These Terms of Service (“Terms”) govern your access to and use of Serostiretail.com (the “Site”) and any related services provided by Serosti Import and Export, LLC (“Company,” “we,” “us,” or “our”), including ecommerce purchases and any shipping/receiving solutions offered through the Site (collectively, the “Services”).

By accessing the Site, creating an account, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

2) Accounts and Guest Checkout

You may purchase through guest checkout or by creating an account.

If you create an account, you agree to:

  • Notify us promptly if you suspect unauthorized access

You are responsible for all activity that occurs under your account.

3) Orders, Acceptance, and Order Limits

If we cancel an order after payment, we will issue a refund to the original payment method.

Taxes

Promotions and Discount Codes

Promo codes and offers are subject to their stated terms and may be modified or ended at any time. Unless stated otherwise:

  • One promo code may apply per order

  • Promo codes cannot be applied retroactively

5) Payments

We accept payment methods displayed at checkout. Payments are processed through third-party payment processors. We do not store full payment card numbers on our servers.

You represent and warrant that you are authorized to use the payment method submitted and that the payment information is accurate.

6) Shipping, Delivery, and Risk of Loss

Shipping options, costs, and estimated delivery times are shown at checkout and may vary by destination and carrier.

Delivery Estimates

Delivery estimates are not guaranteed. Delays may occur due to carrier issues, weather, incorrect addresses, or other circumstances outside our control.

Address Accuracy

You are responsible for providing a correct and complete shipping address. If an order is returned due to an incorrect address, additional shipping charges may apply.

Risk of Loss / Title

Unless otherwise required by law, risk of loss and title transfer to you upon delivery to the carrier. If a package is marked delivered but cannot be located, please contact us promptly so we can assist with carrier investigation procedures.

7) Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Return Policy (if posted) or by return instructions provided by our support team.

Unless otherwise stated in a product listing:

  • Certain items may be final sale or non-returnable

  • Returned items must typically be unused and in original packaging

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the User Content for operating and marketing the Site and Services

We may remove User Content at our discretion.

We do not warrant that the Site will be uninterrupted, secure, or error-free.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEROSTI IMPORT AND EXPORT, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRIOR TO THE EVENT.

Some states do not allow certain limitations, so parts of this section may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless the Company and its owners, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

17) Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, if we believe you violated these Terms or used the Services unlawfully.

18) Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the updated Terms.

19) Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles.

Any dispute arising out of or related to these Terms or the Services shall be brought in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.
